Right, but you can't restrict redistribution by third parties, so why not just put them on the web site? Of course, Tony doesn't need to license the code he wrote (AP drivers, etc) under the GPL. He's the author, and he can create non-GPL'd binary modules if he chooses, amongst other options.
Of course, I hope that he does release his work under the GPL or other open-source license, but (a) he doesn't have to, and (b) there may be IP restrictions that he is under as well (like distribution of the Lucent firmware or source code developed from NDA'd specifications).
